All Users (“Users”) of the website located at givethemten.org (the “Website”), including you (“you”), must read this Privacy Policy prior to using any portion of the Website.  By using the Website, you agree to all terms of this Privacy Policy. If you do not agree with all such terms, you may not use any portion of the Website.

This Website is owned and operated by The Joanie Bernard Foundation. The Joanie Bernard Foundation respects your privacy and has written this Privacy Policy so that you will be aware of the information that The Joanie Bernard Foundation collects from you, how that information is protected, and how it is used. 

The Joanie Bernard Foundation permits Users of the Ten website to provide their name, e-mail address, address, and phone number, (collectively “personal information”), in order for Users to contact Ten, submit information about events, join the volunteer veterinarian and vet tech database, take the pledge to be gonad free, become a feline ambassador, and participate in programs developed by The Joanie Bernard Foundation. We do not sell your personal information to third parties.

I. USE AND DISCLOSURE OF INFORMATION

The Joanie Bernard Foundation permits its Users to provide their name, e-mail address, address, phone number, (collectively “personal information”), in order for Users to submit letters of inquiry, applications, and other correspondence about grants, funding and The Joanie Bernard Foundation. We do not sell your personal information to third parties.

The Joanie Bernard Foundation may also collect non-personal information, including, but not limited to, the Internet Protocol (IP) address of your computer and your browser software (i.e. Internet Explorer, etc.), the configuration used, the pages served, the time, source of a request, or other information. 

Except as otherwise stated, The Joanie Bernard Foundation may use both non-personal and personal User information to monitor and improve the content of the Website, to customize the Website to User preferences, to communicate information to Users, to provide you with information concerning special events, offers or promotions on behalf of The Joanie Bernard Foundation or third parties, to contact you regarding any transaction, contest or promotion in which you have participated, and for any other purposes specified in this Privacy Policy or disclosed when you provide your information.    

II. OUTSIDE CONTRACTORS

The Joanie Bernard Foundation may employ independent contractors (“Outside Contractors”) to provide specific services, including but not limited to, marketing assistance, review and evaluation of applications or inquiries, and developing, hosting or maintaining the Website on our behalf. These Outside Contractors may have access to information collected on the Website, including personal information, in the course of providing such services and will have agreed to use it for the purposes outlined above. 

III. PROTECTION OF USER INFORMATION

Users must keep in mind that no Internet transmission is ever 100% secure or error-free. Although we will use reasonable efforts to protect your information, information posted or transmitted to, or e-mail sent to or from, this Website may not be secure, and you should therefore take special care in deciding what information you post, transmit, or send to us via e-mail. 

IV. THIRD PARTY COOKIES

We, and our Outside Contractors, may place or recognize a unique “cookie” on your browser or use a beacon.  A cookie is a piece of data transmitted to and stored on the User’s hard drive that records information about the User. A beacon is a small piece of data embedded in images on pages of the Website. Cookies automatically identify your web browser to the Website each time you visit the Website.  Many updates and improvements to the Website are based on data obtained from cookies, and such cookies may allow you to personalize your experience on the Website. Cookies may enable The Joanie Bernard Foundation to track and target the interests of Users to enhance their experience.  If a User adjusts the User’s browser to reject cookies, the User may still use the Website.  However, some of the areas on the Website may not provide an acceptable User experience if you have disabled the use of cookies.

The Website may contain links to other websites.  This Privacy Policy applies solely to information collected on or submitted to the Website.  The Joanie Bernard Foundation is not responsible for the privacy practices of other sites linked to the Website.

The Joanie Bernard Foundation reserves the right to disclose your personal information, without notice, if required to do so by law or in the good faith belief that such disclosure is necessary to: (a) comply with legal requirements, legal process, court order or other administrative or law enforcement order served on The Joanie Bernard Foundation, (b) protect and defend the rights of The Joanie Bernard Foundation or verify compliance with the policies of this Website and applicable laws, and (c) protect the personal safety or legal rights of Users of the Website or the public.  The Joanie Bernard Foundation may also use IP addresses to identify Users, and may do so in cooperation with copyright owners, internet service providers or law enforcement agencies in our discretion, without notice to you.

VII. PROMOTIONS

If you choose to enter any contest, sweepstakes or other promotion offered on this Website, your personal information may be disclosed to third parties in connection with the administration of such promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law, such as on a winners list. Also, by entering a promotion, you are agreeing to the official rules that govern that promotion, which may contain specific requirements of you, including, except where prohibited by law, allowing the sponsor(s) of the promotion to use your name, voice and/or likeness in advertising or marketing associated with the promotion.

VIII. CONTACT US; USER SUBMISSIONS

The act of submitting User information, such as a pledge, volunteer sign-up or event details, to the Website, The Joanie Bernard Foundation, or any of its Outside Contractors is voluntary and does not, in itself, create a contractual or confidential relationship of any kind between you and The Joanie Bernard Foundation to publicize an event, list you or any other User on the Ten website, award grants or funding, pay, or otherwise compensate you for the submission of the User information.  You represent and warrant that the User information is true and correct and is either your own personal information or that you otherwise have the right to submit the User information for The Joanie Bernard Foundation’s use.

IX. CHILDREN UNDER THE AGE OF THIRTEEN

Children under the age of thirteen are not allowed to use the Website without parental consent or supervision.  The Joanie Bernard Foundation is unable to prevent children under the age of thirteen (13) from visiting the Website.  However, The Joanie Bernard Foundation will not knowingly collect personal information from children under the age of thirteen.  By providing personal identifiable information through the Website including, but not limited to, your name and e-mail address, you represent and warrant that you are at least thirteen years of age and that you agree to comply with The Joanie Bernard Foundation’s Privacy Policy.  We will delete any information later determined to be from a User younger than thirteen.

X. CONSENT TO TRANSFER

The Website is operating in the United States of America.  If you are located in the European Union, Canada or elsewhere outside the United States, then by your use of the Website, you consent to the transfer of your information to the United States.

XI. NOTIFICATION OF CHANGES

You should review this Privacy Policy whenever you use the Website in order to be aware of the ways that your information is used.  The Joanie Bernard Foundation reserves the right to change this Privacy Policy at any time by prominently posting notice of such change on the Website or otherwise notifying you of the changes.  If you do not accept such changes, you must discontinue your use of the Website.

XII. CALIFORNIA PRIVACY RIGHTS

California Civil Code Section § 1798.83 permits users of our Website who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
